These Terms of Use (“Terms”) govern your access to and use of the Mposit mobile application and website (the “Service”), operated by Mposit (“we,” “us,” or “our”). By downloading, installing, or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Mposit Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18, you must have the consent of a parent or legal guardian. By using the Service, you represent that you meet these eligibility requirements. We reserve the right to refuse access to anyone who violates these requirements.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the Mposit application on your personal device solely for your personal, non-commercial use.

You may not:

• Copy, modify, distribute, sell, or sublicense the Service or any part of it
• Reverse engineer, decompile, or disassemble the application
• Use the Service to develop competing products or services
• Remove or alter any proprietary notices or labels on the Service

4. User Conduct

You agree not to use the Service to:

• Violate any applicable law or regulation
• Upload or transmit harmful, offensive, or infringing content
• Interfere with or disrupt the integrity or performance of the Service
• Attempt to gain unauthorized access to any part of the Service or its infrastructure
• Collect or harvest data from the Service without our express written permission
• Impersonate any person or entity

We reserve the right to suspend or terminate your account for any violation of these conduct standards.

5. Your Content

You retain ownership of any videos, images, or data you submit to the Service (“User Content”). By submitting User Content, you grant Mposit a non-exclusive, worldwide, royalty-free license to use, process, and analyze that content for the purpose of providing the Service to you.

You represent that you own or have the necessary rights to any User Content you submit, and that your User Content does not violate any third-party rights.

We do not claim ownership of your User Content. Please see our Privacy Policy for details on how your data is handled.

6. Health & Safety Disclaimer

Mposit provides AI-powered motion analysis for informational and training purposes only. The Service is not a substitute for professional medical advice, diagnosis, or treatment.

Before beginning any new exercise program or making changes to your training based on Mposit feedback, consult with a qualified healthcare provider or certified athletic trainer — especially if you have any pre-existing medical conditions or prior injuries.

By using the Service, you acknowledge and accept the inherent physical risks of athletic activity and agree that Mposit is not responsible for any injury or health outcome arising from your use of the Service.

7. Subscriptions & Payments

Some features of Mposit require a paid subscription. Subscriptions are billed through your Apple ID via the App Store. By subscribing, you agree to Apple’s applicable Terms of Service.

• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date
• You can manage or cancel your subscription in your Apple ID settings
• Refunds are governed by Apple’s refund policies
• We reserve the right to change subscription pricing with advance notice

8. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software, and AI models — are owned by or licensed to Mposit and are protected by applicable intellectual property laws.

The Mposit name, logo, and tagline “Perfect form. Any sport.” are trademarks of Mposit. Nothing in these Terms grants you a right to use our trademarks without prior written permission.

9. Disclaimers

The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantees about the accuracy of any form analysis or feedback generated by the Service.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Mposit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including but not limited to loss of data, loss of profits, or personal injury — arising from your use of or inability to use the Service.

In no event shall our total liability to you exceed the amount you paid us in the twelve months preceding the claim, or $50 USD, whichever is greater.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we determine violates these Terms or is otherwise harmful to other users, us, or third parties.

You may stop using the Service and delete your account at any time. Upon termination, your license to use the Service immediately ceases. Sections that by their nature should survive termination will survive, including Sections 8, 9, 10, and 12.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved in the state or federal courts located in Ventura County, California, and you consent to personal jurisdiction in those courts.

Before filing any claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for a period of 30 days.

13. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date and, where appropriate, notify you via email or in-app notice. Your continued use of the Service after such changes constitutes your acceptance of the updated Terms.
